1. Acceptance of Terms

By accessing or using SafeHire's criminal background check services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

SafeHire is powered by Certn and connects to official Canadian police databases including the Canadian Police Information Centre (CPIC).

2. Service Description

SafeHire provides criminal background check services for individuals seeking their own criminal record information. Our Services include:

  • Criminal record searches through CPIC and other authorized police databases
  • Identity verification using government-issued identification
  • Secure digital delivery of background check results
  • Customer support for the application process

3. Eligibility and User Requirements

Age Requirement

You must be at least 18 years of age to use our Services. By using SafeHire, you represent and warrant that you meet this age requirement.

Personal Use Only

Our Services are intended for individuals seeking their own criminal record information. You may not use our Services to conduct background checks on other individuals without their explicit written consent and appropriate legal authority.

Accuracy of Information

You agree to provide accurate, complete, and truthful information when using our Services. Providing false or misleading information may result in termination of your access and may violate applicable laws.

4. Service Limitations

Not a Vulnerable Sector Check

Important: SafeHire background checks are NOT Vulnerable Sector Checks and cannot be used for positions involving vulnerable populations, including children, elderly, or disabled individuals.

Immigration and Visa Limitations

Our criminal record checks do not include convictions from the Canadian Border Service Agency (CBSA) or US Customs and may not be suitable for immigration or visa purposes. Contact CBSA or US Customs directly for visa eligibility determinations.

Jurisdictional Scope

Our Services primarily cover Canadian criminal records. International criminal records are not included unless specifically noted.

5. Payment Terms

Pricing

All payments are processed securely through Stripe. Current pricing is displayed during the application process.

Payment Processing

Payment must be made at the time of application submission. We accept major credit cards and debit cards. All transactions are processed in Canadian dollars.

Refund Policy

Due to the nature of our Services and the immediate processing of background checks, refunds are generally not available once a check has been initiated. Refunds may be considered in cases of technical error or service failure on our part.

6. Service Delivery and Timing

Processing Time

Most criminal record checks are completed within 15 minutes. However, processing times may vary depending on:

  • Complexity of your record
  • Need for manual verification
  • Database availability
  • Verification requirements

Delivery Method

Results are delivered electronically to the email address you provide during application. We do not mail physical copies to protect against tampering and ensure security.

Delayed Processing

If your report is not approved within 24 hours, we will contact you by email with next steps and any additional requirements.

7. User Responsibilities

Required Documentation

You must have the following readily available:

  • Valid, unexpired government-issued photo identification
  • Your most recent Canadian address
  • A valid credit or debit card for payment

Information Security

You are responsible for maintaining the confidentiality of your account information and background check results. Do not share your results with unauthorized parties.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using our Services, you consent to the collection and processing of your personal information as described in our Privacy Policy and these Terms.

9. Intellectual Property

All content, software, and materials provided through SafeHire are owned by SafeHire, Certn, or their licensors and are protected by intellectual property laws. You may not reproduce, distribute, or modify any content without written permission.

10. Disclaimers and Limitations of Liability

Service Availability

While we strive to provide continuous service, we do not guarantee that our Services will be available at all times. We may experience downtime for maintenance, updates, or due to factors beyond our control.

Accuracy of Information

We rely on official police databases for criminal record information. While we strive for accuracy, we cannot guarantee the completeness or absolute accuracy of all data sources.

Limitation of Liability

To the maximum extent permitted by law, SafeHire's liability is limited to the amount you paid for the Services. We are not liable for indirect, incidental, or consequential damages.

11. Prohibited Uses

You agree not to use our Services for:

  • Any illegal or unauthorized purpose
  • Conducting background checks on other individuals without proper authorization
  • Circumventing our security measures or attempting unauthorized access
  • Providing false or fraudulent information
  • Using automated tools to access our Services without permission

12. Termination

We reserve the right to terminate or suspend your access to our Services at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.

13. Governing Law

These Terms are governed by the laws of Canada and the province of Ontario. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the effective date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
